The COGNITIVE Philosophy: Sovereignty by Design

Cognitive LLC & Elisium LLC ( “COGNITIVE”, “ELISIUM,” “We,” “Us”) rejects the traditional surveillance economy. We believe that a Cognitive City must be a guardian of human agency, not a harvester of user data.

This document outlines not just how we comply with the law, but how we enforce Data Sovereignty for every resident, guest, and commercial partner. We operate under a “Zero-Trust / Local-First” architecture, ensuring that your digital identity remains as secure as your physical home.

Data Sovereignty & The “Data Spaces” Framework

Unlike legacy smart cities that aggregate user data into a central “Data Lake” (creating a security vulnerability), COGNITIVE utilizes a Data Spaces architecture.

Ownership: You retain absolute ownership of your personal data.
Storage: Sensitive personal data (biometrics, health telemetry, voice logs) is stored locally on your WooHoo® device’s Secure Enclave or your private, encrypted cloud pod. It is not stored in a central ELISIUM database.
Access: When CityOS™ requires data (e.g., to verify residency for gate access), it requests permission via a cryptographic Smart Contract.
Decentralized Identity (DID): We utilize a Digital Ledger to manage identity verification. You hold your private keys. COGNITIVE verifies your credentials using Zero-Knowledge Proofs (ZKP), confirming you are authorized without needing to see or store your underlying personal information.

Biometric Information Privacy Statement

COGNITIVE employs advanced biometric technologies (Facial Geometry, Gait Analysis, Voice Recognition) for seamless, keyless access and security.

Edge Processing: Biometric scanning is performed at the “Edge” (on the camera or sensor itself) or locally on your device.
No Central “Honey Pot”: We do not maintain a central repository of resident face or fingerprint raw data. We store only cryptographic hashes (mathematical representations) that cannot be reverse-engineered into an image.
Consent: By enrolling in the Universal Passport system via WooHoo®, you explicitly consent to the local processing of your biometric identifiers for access control. You may revoke this consent at any time and revert to physical credentials (RFID/NFC cards).

AI Transparency & Automated Decision-Making (ADM)

COGNITIVE utilizes Verdant™ and CityOS™ to automate city operations. We adhere to a strict Cognitive Interaction Hierarchy to ensure Algorithmic Accountability.

The Right to Explanation: Residents have the right to request a “Chain of Thought” audit for any algorithmic decision that results in a financial penalty (e.g., a dynamic parking fee) or denial of service.
Human-in-the-Loop: Any high-stakes decision affecting life safety or property ownership is flagged for human review. Verdant does not have the authority to unilaterally seize assets, lock residents out of primary dwellings, or report private data to third parties without a valid court order or immediate threat to life.
No Social Scoring: COGNITIVE explicitly bans the use of AI for “Social Credit Scoring.” Your access to city services is based on contract and law, not algorithmic behavioral analysis.

Physical AI & Drone Operations (The Sentinel Swarm)

COGNITIVE deploys autonomous systems, including the Sentinel Drone Swarm and Steward Bots, for maintenance and security.

Privacy by Physics: Our drones utilize Vision Language Models (VLMs) to detect behaviors (e.g., a person falling, a perimeter breach, a fire) rather than tracking specific individuals.
Data Retention: Raw video footage from public spaces is processed in real-time RAM and is discarded immediately (within milliseconds) unless a specific security incident or crime is detected. We do not engage in indefinite bulk recording of public movements.
No-Fly Zones: Residential backyards and interiors are strict No-Fly Zones for city drones, enforced by hard-coded geofencing in the Cognitive Constitution.

Commercial Surveillance & The Cognitive Audit

To maintain our “Zero-Leakage” financial standards, commercial partners and construction vendors are subject to algorithmic auditing.

Supply Chain Transparency: By operating as a vendor within the FLUX or PISTA districts, commercial entities consent to the use of LiDAR, Volumetric Scanning, and Computer Vision to verify physical inventory against financial invoices.
Anti-Fraud: Discrepancies detected by the Cognitive Audit system will result in an automatic pause of Smart Contract payments until resolved.

Digital Assets & Utility Tokens

COGNITIVE utilizes Cognitive Credits and stablecoins (e.g., RLUSD, USDC) for internal friction-free commerce.

Not a Security: Cognitive Credits are utility tokens designed solely for internal ecosystem governance, sustainability rewards, and amenity access. They are not securities, investment contracts, or currency. COGNITIVE LLC makes no guarantee of monetary value or liquidity for these credits outside the COGNITIVE ecosystem.
Wallet Risks: While we utilize institutional-grade custody protocols (Self-Custody), you acknowledge that digital assets involve inherent risks.

Florida Digital Bill of Rights (FDBR) Compliance

Pursuant to Florida Law (SB 262), COGNITIVE grants the following rights to all consumers:

The Right to Know: You may request a verified report of all personal data COGNITIVE has collected (if any).
The Right to Delete: You may request the deletion of your personal data from our active systems, subject to legal retention requirements.
The Right to Opt-Out: You may opt out of the sale of your personal data. Note: COGNITIVE does not sell resident personal data to third-party data brokers.

High-Net-Worth Individuals (HNWIs) and Ultra-High-Net-Worth Individuals (UWNIs)

We understand the unique privacy concerns of HNWIs and UWNIs and offer additional safeguards, including:
